The SEC does not discuss active investigations. HOWEVER, we do know that the ALTO investigation is continuing - several shareholders were subpoenaed in that investigation. The ALTO scam used the exact same property and management as EXLA. When ALTO imploded and the SEC came sniffing around, the people behind it just transferred the asset into EXLA for a nominal amount of EXLA shares and continued to run the scam.

And that is a fact. And when the SEC moved against the first set of people behind ALTO is when EXLA and the management disappeared. Not a coincidence.
