All this jockeying and endless delay stems from two, basic realities. The plaintiffs have no real evidence. The government wants to keep it that way.

Last week's filings all boil down to the next, and possibly final round to be played out under a summary judgement without evidence scenario.

The government is holding the trump card in this because a motion to dismiss ends the circus, but a ruling to move on to a summary judgement can always be appealed. So I don't expect the government to waver and produce anything meaningful at the 11th hour.
