mickey: Maybe you are just confused about various cases related to LG since you refer to McWane..

Shortly after the arbitration proceedings began LG complained to the arbitration panel that IDCC had submitted certain documents to the panel that LG complained should not have been disclosed because of a non-disclosure agreement (NDA). The panel determined that it would rule on the issue later. LG then filed suit in Delaware State Chancery Court, seeking an injunction requiring IDCC to withdraw the documents from the arbitration and not violate the NDA in the future. Citing the McWane ruling the Delaware Chancery Court ruled in IDCC's favor and was later upheld by the Delaware Supreme Court so the arbitration proceedings were continued with the IDCC submissions included.

The above has nothing to do with IDCC's Feb 5 filing in the US Southern District Of NY. As has been explained to you, that filing was a normal petition by IDCC to have the Court confirm the arbitration award and issue a judgement. The Judge has not ruled on that petition, and it is quite possible that LG will file a response asking the Court to vacate the arbitration award.
