The question remains the same - why didn't HJOE provide PLN the documents they requested during discovery?

If HJOE had such a strong case why would they file a Joint Motion for Dismissal - why wouldn't they have kept it in court to force a settlement that the court could enforce?

The answer is that HJOE couldn't document the losses they were telling shareholders.
