A difference between the Vringo and VHC cases is that attorney fees may well be awarded against Apple in the VHC case. This would be a big deal. It’s much easier to obtain attorney fees if the infringer was willful in its actions, and VHC alleged willfulness, and willfulness was found. Of course if CAFC [Not CAFTA --- Central American Free Tree Agreement--- ] continues to violate statutory law and case law and tradition by examining patent appeals de novo, VHC could lose, just as Vringo lost. jmo
