It is not uncommon to have loophole and ambiguity in the laws, and it must be up to the Court to make the interpretation and second guess the law makers when the laws are not clearly defined. And if Congress does not like SCOTUS' interpretation of its intents or laws, then Congress can enact new legislations that would satisfy its lobbyists or other special interest groups.
