This is HIGHLY positive for WDDD, the NPE sector and patent holders in general.
1. This ruling will have a MATERIAL impact on WDDD and the Bungie/Activision gaming.
2. Seems as though our friend Michelle Lee, the google and potus plant for google has gone too far across the line and is now effectively trying to rewrite the laws for her past employer - sound familiar? (see vrng)
3. The fact scotus has taken this tells us they see an issue and are clearly likely to address it - as most know, scotus only takes cases it has issue with
4. This should take away a great deal of leverage from the PTAB and their death squad reviews, thus decreasing the ability of big companies to:
A) Play the drag it out game
B) Invalidate valid patents
5. As a result, Patent holders should benefit as the courts will actually UPHOLD them and be the arbiters not some paid google executioners creating a world that they want, vs what THE CONSTITUTION OF THE USA SAYS
6. This should in our view help attract capital back to this sector as:
A)It makes NPE's attractive again, in that the risk will have decreased of patents being invalidated on a whim
B) The stocks have taken a beating, and many are extremely undervalued as a result - so there is value in many of these stocks
C) The leverage of larger companies with deep wallets will have decreased thus likely leading to more out of court settlements - in essence one of the biggest weapons in their arsenal will be removed - that being Ms Lee and her Google instructions.
D) Increases risks for shorts and those making 'sector short' bets, which we believe has occurred in the NPE sector. We suspect that a great deal of covering in these stocks will occur as we get closer to that ruling by Scotus.
E) It SHOULD make capital easier to raise for high quality NPE's and those who execute well. VRNG management now needs to start showing they can monetize (DTV will be a good start). If so, this should help their mid and long term share price prospects.
7. The issue for WDDD is quite clear. If Scotus sees issue with this WOC, then the PTAB arguments of Bungie / Activision are moot and they are cornered (regardless of the arguments coming forward). It certainly appears as though Ms Lee and the PTAB have been doing their big pocket friend's bidding in order to make patents free for everyone but the big boys. Should SCOTUS finally address this nonsense, this stock will see significant gains IMHO.
