I don't believe they've got anything other than nuisance value going for them.

My belief is there was no violation of SEC rules and suggesting positive results and consistently missing due to misjudgement is not a crime nor a violation of rules. Neither is trying to put the best spin on what you report, barring outright lying about some material item that was known to be opposite of what you report.

Terms like "think", "believe", "project", "opinion", "expect", ... provide cover against "intentionally misleading", as does the blurb about "forward-looking statements" which is a part of every results reporting activity.

Failure to properly assess global economic conditions, US $ strength effects, sanctions effects, ... is neither unique to $CPST nor a crime nor a violation of SEC rules.

Neither is failure to control costs relative to revenues.

I think it'll drag on for a long time though and distract management and shareholders and consume some valuable resources.
