Delay is part of the legal process for any well funded company or defendant vs a poorly funded plaintiff (even if the lawyers are on contingency), why?

1. Delay hurts the plaintiff, simply out of frustration, time value of money etc. so there is a strategy to force the other side to accept less in a settlement. This by the way happens in pretty much most lawsuits (this reason).

2. It sends a message to other companies and NPEs that 'we won't just capitulate and pay you, so you better be well funded and expect fight'. It's a deterrent. This is one of the main reasons they do it. If you willingly settle for a large amount, others will come at you very quickly with frivolous suits.

3. Finally, the hope of delay is also either to get lucky with a PTAB review, a jury, or even appeals like Goog v VRNG, and actually win the case when you really are infringing. And sadly, that happens alot.

Don't expect ATVI to settle quickly folks. The reason the stock is at 6 cents is the market has learned about NPE's, it doesn't happen quickly and takes years.
