The "hillside chipping" at the Keystone that was done early on could be construed as mining. As such, he violated ADEQ and MSHA regulations. The processing at the Aguila facility is also regulated under MSHA and ADEQ, but it is less clear who is really responsible for that operation. The land owner, the operator of the equipment, or the supplier of the "ore"?
