Heart attack gets movie producer sentencing delay in film tax credit case

The day after a jury found Peter Hoffman guilty of bilking a state film tax credit program of more than $1 million, the Hollywood producer was poring over law books in the library of the 5th U.S. Circuit Court of Appeals. A month later, he had a heart attack, followed by triple-bypass surgery.

A federal judge Thursday (June 18) granted Hoffman a six-week delay to his August sentencing date, to give the 65-year-old time to recuperate and help his defense team prepare motions seeking to overturn his convictions on 21 counts.

U.S. District Judge Martin Feldman granted the extension to Hoffman and his two co-defendants, his wife, Susan Hoffman, and New Orleans actor and attorney Michael Arata.

Hoffman in April was convicted in an scheme to defraud the a tax credit program intended to spur investment in Louisiana's film industry, by falsifying records to pump up the amount of money he was spending on a years-long project to renovate a dilapidated Esplanade Avenue mansion into a state-of-the-art post-production studio.

Prosecutors opposed the delay, noting that Hoffman's lawyer hadn't raised the issue of his client's heart attack and surgery during scheduling hearings with the judge that took place just days after Hoffman's operation.

Hoffman, who also is an attorney, "has a history of well-documented history of misusing litigation and disrespecting the judicial process when far less was at stake" than a prison sentence, Assistant U.S. Attorney Chandra Menon wrote in a motion opposing Hoffman's request.

A California judge sanctioned Hoffman in 2008, finding that the producer "for years engaged in conduct that is easily classified as abuse of litigation and arbitration, deceitful, fraudulent, contemptible, harassing, vindictive, intimidating, and frivolous." In another lawsuit, a judge found Hoffman in contempt, noting his "history of stone-walling and misrepresentation," Menon wrote.

Sentencing for the Hoffmans and Arata is set for Sept. 30.
