The real crux of the Delaware case seems to be the 100% sweep and the "perpetuity" claim that seems very far-fetched to me as a legal basis for complaint since Amendment 3 was only put in place in 2012 which is far from an eternity.

I have said for a long time that the government would have a strong case for a 79.9% sweep, not a 100% sweep. No way to predict how the judge will respond to any of this, however.
