Correct... If that hearsay so posted is accurate and true, then yes, just so long as the person that obtained it does not act upon it, then no violation of the law has been committed.

Clearly you need to expand "act upon it" to understand that the poster did indeed act upon it by making this Insider Information available to the public.

This is clearly stated as such with the law of Insider Information with example that the person so receiving this Insider Information obtained it not through their direct actions to obtain it, but by happenstance, and they are bound under the securities law not to act upon it, which includes not making this information public.

So here, once again, if that hearsay so posted on this board is accurate and true and represents Insider Information of significant activity that can be used in an unfair advantage trading BORK, and that person make public that Insider Information on a public forum (this IH board) its a violation of the law since the poster did indeed "act" on it by disclosing it to the general public.

But we all know that what was given as fact was really just hearsay and does not qualify as anything more than an opinion.

Bottom Line: Truth be known, its just John Bourque's continued tactics to have his next group of IIs (11s) deliver to the Hurting in the Dark Shareholders "feel good" lies and misinformation.

The Minty Green Kool-aid is not spiked with sugar, but hearsays.
