There could easily be a real difference of opinion about the earlier results and Dr. Harris could still be under contract for more tests. NNVC saw the initial data and chose to interpret it as showing that Denguecide has a promising level of efficacy. Maybe Dr. Harris with the same data thought, "It's ambiguous, maybe it worked a bit" but decided its worthwhile to test an improved version.

That difference in opinion isn't worth suing about, but makes a big difference in the PR spin.

We won't really know what Dr. Harris thinks until she tells us, and she hasn't told us so far.
