My initial thought was that IDCC should not appeal to the cafc. After re-reading the commission decision I am of the opinion IDCC should appeal. It seems the commission just ignored the prior claim construction of the cafc and themselves which were different constructions tha in the 800 and 868 cases.

The finding of no infringement based on preclusion seems to have given the commission a place to hide. Yet they never resolved the various patent constructions between the 613/800 and 868 as was outlined by the ALJ and the staff attorney. So the resolution of the inconsistent rulings is still unsettled.

So off to the CAFC IDCC needs to go.

After all why should we take the foot off of their necks. After a good nights sleep I am resolved that the bully needs to know the won the round but not the fight.
