We have to remember. This is JUST the PENALTY phase of the trial. The trial itself is OVER. the defendant gave up (Too early probably, and I thnk he regrets that now) and agreed to lose the case. Then, when he didn't present anything for DAMAGES, the company asked for a LOT of money. The judge said they presented nothing (Because it was never required, asked for, or debated) to substantiate the DAMAGES they wanted, so set a second phase of the trial, to go over damages. As to who will "win"? That part is OVER. I've heard "they gave no credible evidence". yes, that is true. For the DAMAGES. Because the case never really was heard. It was settled by the defendant. Now the defendant is getting a second chance. To lessen the DAMAGES. NOT to determine who wins. Please understand. that is DONE.

I don't think SFRX should put much effort into this phase of the trial. The defendant won't pay up, so why worry about getting a judgment? the defendant WROTE on a different board that he HID what money he had, so SFRX would not get it. Of course, that post will probably be brought to the attention of the judge, so maybe they will go after that anyway. Or find him in contempt. But I don't see a lot of upside for SFRX now that they WON the first part of the trial. that was the important part. Now - they need to get the final I's dotted and T's crossed, get the missing permits, and start diving IN EARNEST for the treasure they EXPECT is there. And you know what? I have no problem in the expectation and hope that "treasure will be found within a week of starting diving on the right spots, once the permits are finalized." And although roadblocks have been set up, and permits are not in hand yet, I feel strongly they WILL be (and should be already by now, in diving season!), they will be SOON, and then I feel we WILL find treasure. SOON. ANd BIG.
