Now back to the NDA, clearly ZTE could be subject to massive fines and be forced to pay Vringo's legal expenses due to NDA violations.
What about a payment to VRNG for the monetary loss of the disclosure along with additional punitive damages? This is all up in the air - right? Any similar NDA violation cases where the plaintiff got large damages? Didn't this judge stop short of providing such compensation to VRNG in his prior ruling a couple of months ago? I know all this is separate from the patent claim aspect.
Also, the alleged violation of federal securities laws and alleged loss to VRNG and its investors due to stock manipulation would likely be outside the NDA case and be handled by the enforcement division of a state and/or federal regulator. Is that right?
I assume ZTE could also be subject to private litigation and class actions given the recent disclosures.
