Easy in answer to your question...the court itself, sua sponte, can raise the question of its jurisdiction to decide a case at any time before it actually decides the case; an appellate court can decide the lower court had no jurisdiction to hear/decide a case when the case is brought to it on appeal.

Jurisdiction of any court is ordinarily conferred by statutes enacted by Congress. I have yet to read FDA/DOJ position here, much less understand the basis for its argument. I may have more to say on the point you raise later. I thought the issue raised by AMARIN was of Constitutional dimension......
