(1) NNVC clearly knew in early 2014, well in advance of BASI, that it would need kilograms "plural" of Flucide for Tox. They said so in their filings. NNVC claimed scale up was complete and they can and are producing what is needed in large quantities necessary for Tox. A reasonable person would conclude what is "needed" is "estimated at kilograms" because that's exactly what NNVC's own SEC filings said.

(2) NNVC through BASI began Tox in October 2014. Everybody was thrilled.

(3) Now, nearly a year later, Tox is completely halted. Seymour is now claiming it's stalled because they only found out about the multiple kilogram requirement only after Tox began. Strange -- the filings he personally signed say he was well aware of this requirement long before BASI began Tox.

(4) Is Seymour senile or a liar?
