It is not slander if it is True. The burden of proof is on Steve to prove that Fred knew it was not true when he posted it. 1st amendment rights permit Fred to post his opinions about Steve who is a public figure. He will not be able to do that and he will end up accelerating all the actions being taken to protect the public. A simple walk through the recent 10K and the 10Q's before it justify everything Fred posted. Steve will not be able to prove that the information from his own CPA firm supports Fred's case and dispels any charges against Fred's opinions of those facts reported to the SEC.
Steve is digging a bigger hole by trying to suppress Fred's free speech. If this goes to court it will backfire on Steve. The press he has no control over will have a field day disclosing the evidence and testimony available to Fred to defend himself. As far the the legal funding goes, a group of supporters is already preparing to fund his defense. So Steve can either chose to spend shareholder's money on buying parts to tune cars or he can continue to blow it on trying to suppress the first amendment rights of one or two bloggers telling the truth about him and Saleen.
