The BLM will take your annual fees, even if your claim is completely invalid. I have seen circumstances where the claim was staked entirely on older, valid claims, yet the BLM took the fees anyway. I guess someone was trying to pick up a little fraction, so I understand why that was done. But I have also seen a bizarre situation where the claims were filed on patented (County-assessed) land, yet the BLM continued to take the annual fees. The local BLM representative thought it was funny that someone would file federal mining claims on private land. What wasn't so funny was that these bogus claims were being resold to gullible investors.

Not quite the same here, but the bottom line, the BLM is happy to keep taking annual fees for land that cannot be mined (or even explored) for at least 15 years.
