HDG - to quote JL, "do you ever read anyone else's posts?" - your part A is nearly identical to stuff I've already posted - but I won't complain, just reinforces the issues here.

Have to sorta agree that Part B, 2.b., is the likely outcome here, unless the judges gets irritated enough to issue the FDA a major smackdown. Hope you're wrong about no SPA lawsuit, but I still say no court will accept it until AMRN exhausts all levels of FDA administrative appeals, waste of time or not. Maybe if AMRN wins the case there will be no need to pursue the SPA anyway? Only thing they could gain is possible on label insurance coverage, but the CRL is still standing in the way of ANCHOR approval - don't believe there is any avenue to sue over a CRL, even if it's based on severely flawed decisions.
