that is absolutely true. mm's have an exemption to the short rules. always have.
however, the margin requirement on a .16 stock is huge, and the type of mm's that make a stock like uspr, do not have the type of capital to carry a large short position in a .16 stock.
do yourself a favor. look at the most recent 10Q for uspr. see all the converts they have. go read their recent pr's and see they recently did another convert.
this volume is coming from convert holders not shorts.
