The civil suit is centered around a single generator that allegedly did not get delivered to the plaintiff with other generators that were delivered, and "lost wages" due to some lack of corporate support. The judge will decide based on testimony and evidence if any fraud was committed. From what I have gathered from the docket entries, ARTR defense had subpoenaed a material witness from the plaintiff side, but counsel filed a motion for protective order in effect blocking the subpoena, citing inability to meet with ARTR defense lawyers due to work schedule and logistics. The prosecution had originally requested a default judgement against ARTR (plaintiff would win without trial) because ARTR was late lawyering up, but since the court granted the protective order for the prosecution, it also nullified the default judgement request, which then triggered a court order setting the bench trial date.
