I spoke to my lawyer about what they call rules of civil procedure. If one side, let’s say IFUS sets down a time for depositions and the other side cancels, then the party that sets the time place and date for the depositions must file a cancellation. That does not mean at all that IFUS WANTED TO CANCEL them it was because SA and JS were either hiding and could not be served or their lawyer, one of many, refused to accept service. Why? Maybe since they had not been paid what they were already owed they did not want to waste more money they will never get paid on depos. There is nothing in the list of filings that indicate that IFUS delayed.. whereas on the contrary the other side did. Clearly they have not offered themselves up for depos AND now that they have a new lawyer, he says he cant do them either because the old law firm Rivero Mastre wont give up the files. Hmmmm, sure sounds like delay tactics to me. Is it because they are losing in State court????
