HEY! I've been keeping up with the filings at the ITC and the discussions regarding what is going to happen with the full commission on the issue preclusions/estoppel. Obviously, there is confusion, but It appears that the staff attorney is not saying that estoppel should preclude Judge Andrew's decision in the 613 case. My read is they would like to have an opinion from the full commission as to the differentiation in the three cases and possible conflicting claims construction such that they will have guidance going forward for use in future cases and such that attorneys for other companies(infringers) will know how to advise their clients in what otherwise are conflicting claims constructions and decisions on infringement.

Hopefully, the Commission with affirm all and offer some weak, pitiful excuse as to why they did what they did. (other than blatant political pandering).

Of course, this is just a guess. Hopefully, we will get IDCC version of the truth pretty soon.
