I don't see how that passes. You cannot steal someone's capital and then use it for a legal defense. When you lose, there is no recourse for the victim to recover damages. I believe you will see victim rights groups protest it. Seize assets used by stolen proceeds, don't seize assets that were attained prior to the scheme.
