Overstock is not private. They trade on NASDAQ and have since the IPO in 2002. They also filed an S-3 today to sell an additional $500,000,000 in shares.
FASC can't even afford the $700 to be an active corporation and conduct business legally, much less the money for the audits and SEC filings. How would they pay common shareholders to go private?
