nice try. check the court documents. the motion to dismiss was withdrawn based on stipulation that the original complaint would be withdrawn and an amended complaint would be filed by december ( later extended to january 23rd) . both those deadlines were missed and therefore there is currently no complaint pending. the 3rd party complaint was filed by wagner after that deadline was missed. i live with a lawyer who has read these documents a dozen times. i know of what i post.
