But that doesn't necessarily rule it out. Perhaps he owned 10 million shares ( from the private placement)and that wasn't over 5%, but then bought 3 million more ( which then made him over 5* and required the filing). It doesn't meant he recently bought all 13 million. Again, I'm not sure what he did, I'm just saying we don't know when he bought and for how much.
