Besides the phony aspects of Bourque Industries, previous posted, that give it the appearance of a real company staffed with officers, Bourque Industries has also aligned itself with the following definitions that in a way exempt them from the consequences of being tagged a shell company even-thought for the past two years they have surely existed as such.

Also, another manner to "escape" delisting is when the company was not a shell, but now is, and has plans to function again as a real company.

"A company may have had operations, but those may have shrunk or ceased due [to] company mismanagement and now exist with characteristics of a shell company that has only enough cash to keep it's website up, but no longer has a facility or workers capable of producing a product."
