Judge Mueller has 2 grounds to overcome:

(1) Is marijuana classified as Schedule I of the Controlled Substances Act unconstitutional "on its face?"

(2) Is marijuana classified as Schedule I of the Controlled Substances Act unconstitutional "as applied?"

I don't think she can get there on Ground I, but I believe she will nail Ground II. All you need is one ground to prevail.
