Section I. General Conditions of
Contract

23.5 The Purchaser may require the Supplier to carr
y out any test and/or inspection not required by th
e Contract
but deemed necessary to verify that the characteris
tics and performance of the Goods comply with the t
echnical
specifications codes and standards under the Contra
ct, provided that the Supplier’s reasonable costs a
nd expenses
incurred in the carrying out of such test and/or in
spection shall be added to the Contract Price. Furt
her, if such test
and/or inspection impedes the progress of manufactu
ring and/or the Supplier’s performance of its other
obligations under the Contract, due allowance will
be made in respect of the Delivery Dates and Comple
tion
Dates and the other obligations so affected.
23.6 The Supplier shall provide the Purchaser with
a report of the results of any such test and/or ins
pection.
23.7 The Purchaser may reject any Goods or any part
thereof that fail to pass manufacturer’s prescribe
d field test
and/or inspection or do not conform to the specific
ations. The Supplier shall either rectify or replac
e such rejected
Goods or parts thereof or make alterations necessar
y to meet the specifications at no cost to the Purc
haser, and
shall repeat the test and/or inspection, at no cost
to the Purchaser, upon giving a notice pursuant to
GCC Sub-
Clause 23.4.
23.8
The Supplier agrees that neither the execution of a
test and/or inspection of the Goods or any part th
ereof,
nor the attendance by the Purchaser or its represen
tative, nor the issue of any report pursuant to GCC
Sub-Clause
23.6, shall release the Supplier from any warrantie
s or other obligations under the Contract.
Warranty
24.1
The Supplier warrants that all the Goods are new, u
nused, and of the most recent or current models, an
d
that they incorporate all recent improvements in de
sign and materials, unless provided otherwise in th
e Contract.
24.2
Subject to GCC Sub-Clause 19.1, the Supplier furthe
r warrants that the Goods shall be free from defect
s
arising from any act or omission of the Supplier or
arising from design, materials, and workmanship, u
nder
normal use in the conditions prevailing in the coun
try of final destinatio
