I blame NNVC. Blaming the FDA is like somebody in Buffalo who refuses to shovel his driveway blaming the weather when he can't get his car onto the street. Nothing of significance has changed about the FDA since NNVC started. NNVC has known the rules from the start. And I bet you don't volunteer to test drugs in phase 1 trials that haven't been put through very rigorous pre-clinical toxicity testing -- the kind of testing the FDA requires.
