Didn't it come from the Texas State security board? They actually have more criminal jurisdiction as to prosecute than the SEC. The SEC would have to turn their findings over to the DOJ (US Attorney) for them to file criminal actions as the SEC has civil jurisdiction or the SEC would have to work with the DOJ on the case. I think that has already happened and criminal indictments may be just around the corner.
