If a person goes into a store like Walmart and steals a peanut butter cup they will be prosecuted for just $ 1.20 and will spend time in jail possibly even get a felony.

If an investor invests $1000.00 or more in these types of stocks and fraud truly is happening?

Nothing happens only the unsuspecting investor suffers and isn't fair or ethical just extortion on the highest levels involving humanity.
