The Teva vs Sandoz decision would seem to say that. Obviously, we would be looking at some type of constitutional issue if all lower justice decisions were correct, and no appeals were valid. The exception seems to be a concept called "clear error", and since the staff is behind us 100%, would apply here. I think we all agree that the lower courts treatment of our IP has constantly been in error, who knows how clear
wireless IP will ever get.
