Because they knew they would win outright and cost them nothing. If I sued you right now because you were cutting your grass with a lawnmower I invented, but was like all the other ones. Would oyu just go ahead and pay me ?

Same thing here, this patent is totally worthless now. Maybe, 4 years ago they had a shot, now, nothing...
