It should absolutely run with a positive Markman. The question is how well will the Markman go? The more claims they win the more it will run imo because investor confidence will be stronger.

History shows that if the plantiff does well in the Markman they prevail at trial. The more claims won the better the chances are for winning at trial. A complete domination at the Markman could generate some legit settlement talks because potential treble damages are very real in this case.

Remember VRNG did very well their Markman hearing. Unfortunately the people that just throw money blindly into VRNG only know that VRNG lost, but not how they lost.
