It would be both a civil and criminal offense. That is something I don't do nor would do even if it were legal.

I'm extremely careful in my wording. When I've been wrong about a fact, those very rare times, it was an honest mistake and I quickly own up to it if it was material.

I would be especially careful about lying in email or phone about positive info -- that's what the SEC and DOJ prefers and more often does bust (yes, even to one party). The good news it is often hard to prove you knew it was a lie and weren't just bloody stupid.
