They avoid the courts because it wasn't a bankruptcy filing. It was all done 'pursuant to Section 9-620 of the Uniform Commercial Code.'

IMO certain people who benefitted from the transaction knew exactly what was happening. Probably very difficult to prove, hence no lawsuits to date.
