FRAUD - intentional perversion of truth in order to induce another to part with something of value (Merriam-Webster).

tmm and its insiders all knew tmm had NO LEGAL RIGHTS to any Iterated/HP tech yet they issued news releases and web site comments that they did.

tmm raised about 5 million dollars from private placement investors based on those misrepresentations. Millions of dollars more were traded on the public stock exchange based on those misrepresentations.

Looks like a textbook definition to me.
