Oh wait, he just did. In a sneaky roundabout way via the hijacking of the 3(a)(10) exemption.

Just look at who all wants paid and for what "services" provided. It is quite a read. There also seem to be a few legitimate claims for payment in there from small time folks (i.e. real drillers) who actually worked and then got stiffed by XNRG. Their claim amounts are pale in light of the amounts sought by others whose services were nebulous, at best.

Jerry Mikolaczk. 387.275K owed for three months of services in the prior period directly before he became CEO. 415 hrs in three months @ $350 per hour.

CM Research LLC. 365K for Investor Relations and Marketing beginning in May 2014.

Vencedor. 865K for five wells drilled when only Rice #15 has actually been drilled, and that was supposedly already paid off via CPN's according to Mikolaczk.

They could have asked for a "no action" review by the SEC before pushing this 3(a)(10) exemption through. But they did not, they had it rubber stamped by a judge as all parties agreed to the terms of the "settlement" for the "lawsuit" against XNRG.

The whole lawsuit in the first place and settlement via a hijacking of the 3(a)(10) exemption is just another attempt to scam the public for even more money.

It is one thing to run a penny stock scam on folks, and another thing to try to run a scam on the SEC via hijacking an exemption for your own devices.

I don't see anything legitimate about this whatsoever. I cannot fathom in any fashion how the public should be asked to pay for these "services" provided.

That's how I see all this BIG BUSINESS with slightly less than 1000 hours of due diligence performed.
