World Hemp Oil Launches Legal CBD Oil

"In the United States, there is a growing trend of state legislatures that are legalizing limited versions of medical marijuana. These states, such as Florida, legalized a non-psychoactive strand of marijuana that only contains the chemical CBD; the most popular strand of this is known as Charlotte’s Web.

However, many states that legalize this limited form of medical marijuana are still plagued by delays and disputes over how the state’s program should run. As a result, many patients suffer so politicians can try to look “tough on pot” while also trying to seem “sympathetic” to the plight of sick children, but that may soon change.

On November 21, 2014, the company known as World Hemp Oil announced the launch of a hemp-based CBD oil that is comparable to the popular strain Charlotte’s Web. Normally the announcement of hemp oil isn’t enough to get investors in a tizzy, but what makes this product so interesting is that it is going to be legal in all 50 states. Yes, you heard that right.

If you are confused as to how CBD hemp oil can be legal in all 50 US states, don’t feel bad; it is a little confusing. Although marijuana is illegal in most of the United States, CBD and hemp are not.

In 2001, the DEA issued a rule banning all import and cultivation of industrial grade hemp. In 2003, the Hemp Industries Association filed an Urgent Motion for Stay in the Ninth Circuit Court of Appeals. In 2004, the Ninth Circuit Court sided with the Hemp Industries Association.

In the decision, Judge Betty Fletcher wrote, “[T]hey (DEA) cannot regulate naturally-occurring THC not contained within or derived from marijuana-i.e. non-psychoactive hemp is not included in Schedule I. The DEA has no authority to regulate drugs that are not scheduled, and it has not followed procedures required to schedule a substance. The DEA’s definition of “THC” contravenes the unambiguously expressed intent of Congress in the Controlled Substances Act (CSA) and cannot be upheld.”

Judge Fletcher is essentially saying that the DEA cannot regulate hemp or the chemicals within it because hemp contains no THC, is not marijuana, and is therefore not covered under the controlled substances act; and the DEA cannot regulate substances that have not been scheduled. This is why you can purchase and sell CBD hemp oil.

You may be wondering why more people in the United States haven’t just produced hemp oil themselves. That is because hemp is still not 100 percent legal. Under the Controlled Substances Act, hemp as a plant is considered marijuana; however, the definition of marijuana does not include “mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant.”

Basically, hemp as a plant is illegal, but as a product it is not. So while it may be nearly impossible to grow in the United States, you are free to import the product if you wish. If this reasoning seems stupid and convoluted to you, that’s because it is. U.S. drug policy is an idiotic patchwork controlled by bureaucrats and politicians.

While poor public policy has kept American farmers from growing hemp, it is has not stopped American entrepreneurs from selling CBD-based products derived from hemp. There are companies like Natural Wellness Remedies and CannaBisEology sell CBD creams, oils, and elixirs; there’s even a company called Canna-Pet that sells CBD supplements for older dogs.

What makes World Hemp Oil’s product different from these companies is that while companies like Natural Wellness Remedies call their products “supplements,” World Hemp Oil is billing their hemp oil as actual medicine in direct competition of strains like Charlotte’s Web.

If World Hemp Oil’s CBD oil works as advertised and is properly marketed, this could shake up the medical marijuana industry. There would be a cheaper, more widely available, alternative to CBD-only cannabis; and the people who are invested in CBD-only marijuana would face legitimate competition.

This introduction of World Hemp Oil’s CBD oil alternative may not uproot the cannabis industry, but it may bring hope to desperate families in need of some relief."
