If the state decides for a new trial, then John Bourque will remain in jail with the bail option denied. If so, then a new trial may not be scheduled for many months, perhaps with the state doing what John Bourque did, as in delay delay delay until near his 4.5 year original sentence is reached, which upon the state may figure John served his time in full and change their tune not to have a new trial knowing John will eventually get caught in another DUI.
