BIG's best defense to a charge of promoting pump & dumps is that he's never been able to run a pump. His picks just take huge dumps. It's harder to convict a paid promoter of scam stocks when their promotional efforts all fail badly and drive the price DOWN.

So as long as Bennie keeps alerting loser stocks like NTEK, NWGC, FITX, APPG, etc. that simply drift south after his reco's, he's not likely to get nailed by the SEC because there are no profits to disgorge - well other than those profits from the insiders who compensate him to pump while they dump their free or 0.0001 cost-basis shares into the herd.
