The suit against Protect America was withdrawn, maronti.

That much we all know.

We also know that:
there's been no decision on whether or not any REVO patents have been infringed;
there's been no announcement of any amicable settlement between Eyetalk365 and Protect America;
there's been no news of a license agreement with Protect America; and
there's been no news of any proposed buy-out of REVO by Protect America, or anybody else.

Attorneys acting for Eyetalk365 are not rookies. And only a rookie would have agreed to withdraw the suit on the basis of a vague and unenforceable 'undertaking' from Protect America, to launch a buy-out that they can't finance.

I don't believe that scenario, because I don't think the Eyetalk attorney would make such a rookie mistake. It seems that you share my view.

I think it's much more likely that the suit was withdrawn because it was not going to succeed. It would be a rookie mistake to proceed with a case which had little hope of success.
