Only the company and the SEC would know that. Maybe the SEC contacted SPEX for investigative inquiry, but that is a very large assumption for the moment.

I would tend to believe that SPEX would not have influenced the SEC in a follow up, only as it creates another lawsuit. One law suit is cheap compared to two. Now the settlement could be less in both cases, as the company is going to try and settle the disputes within their own means.
