Before you complete a merger you must do a DD process of checking to see if the target of the merger had ever completed one before. This is just like when you go into escrow on a house, you get title insurance and make sure that nobody had sold that house before and to see if the owner of the house you are buying has clear title. The DFI/ TMMI merger clearly passed this process otherwise you would not have been able to complete it.
