There is also a rule that they can not buy back shares if they have inside knowledge of impending actions that have not been released to the public (specific buyout negotiations) or (specific licensee negotiations). The daily volume is relevant to daily buybacks not overall buybacks. There are special provisions for large block private buybacks also.
